NOTIFICATION
S.O .......... In exercise of the
powers conferred by the Proviso to article 309, read with Clause (5) of article
with clause (5) of article 140 of the
Constitution, and after consultation with the article comptroller and Au ditor
General of India in relation to persons Per vin in the; Indian Audit and
Accounts Department, the Presid ent
hereby makes the folio wine rules further to amend the Fundamental Rules,
namely:
1. (1) These Rules may be called
the Fundamental
(Second 'Amendment) Rules,1989.
(2) They shall come into for can
on the date of their pu. blication in
the Official Gazette.
2. In rule 56 of the Fundamental
Rules, for alause (j), the following clause shall be substituted, namely:-
ii(i) Not with standing anything
contained in this rule, the appropriate authority opinion shall, if it is of
the the public interest so to do have the absolute right to retire any Government
servant by giving him notice of three months not less than in writing or three
Months' pay and allowances in lieu of such notice-
(i) If he is, in Group 'A' or
Group ‘B’ service or post in a substantive, quasi-permanent:- or temporary. capacity and had entered Government
service' before attai nine the age of 35 after he has attained the age of 50
years.
(ii) in any other Case after he has attained
the age of 55. Years
Provided that nothing in this
clause shall apply Government servant referred to in clause (e), who entered to a Government service on or before the 23rd July, 1966.”
