I have joined the Directorate of Census , MHA, GOI in the Year 03.11.1982, as statistical assistant in the pre-revised pay scale of Rs. 5000-8000 and accordingly granted a grade pay of RS. 4200/- and granted 2 ACP’ in the scale of 5500-9000 and 6500-10000. Since today I have not got any promotions.

As per the recommendation of 6th CPC I have been granted 2nd ACP from 01.09.2008 in the grade pay 4800.

The DOPT Om No. 35034/3/2008 Estt(D) dated 9th September, 2010 clarified that since the new MACP has come into existence w.e.f 01.09.2008 the previous ACP is applicable in the new pay structure adopted w.e.f 01.01.2006 and ACP is allowed in the existing normal promotional hierarchy. Sl.No. 1 of the clarification issued by the DOP & T vide OM F.No. 35034/1/97-Estt(D) (Vol.IV) dated 10th February, 2000 wherein it has been clarified that” since the benefits of upgradation under ACP Scheme (ACPS) are to be allowed in the existing hierarchy, the mobility under ACPS shall be in the hierarchy existing after merger of pay scales by ignoring the promotion. An employee who got promoted from lower pay-scale to higher pay-scale as a result of promotion before merger of pay scales shall be entitled for upgradation under ACPS ignoring the said promotions”
Statistical Investigator Gr. II - Rs. 4200
Statistical Investigator Gr. I - Rs. 4600
Assistant Director - Rs. 5400/-

As the post in the pay scale of Rs. 5000-8000 has been merged in the pay scale of Rs. 5500-9000 the promotion granted to me in the pay scale of Rs. 5500-9000 should be ignored as per the OM referred in the previous para and accordingly I am entitled to get II ACP after completion of 24 years of service, in the post of Assistant Director (T) with grade pay of Rs. 5400/- as per the existing hierarchy, with effect from 06.11.2006
